Employers should note that from 2006 new legislation means they will be liable for a civil penalty of up to £2,000 if they employ illegal workers.  In addition this legislation creates a new criminal offence of up to two years imprisonment for knowingly using or exploiting illegal workers.

 

These notes have been prepared using the latest Home Office guidance (April 2004).  They are designed to give employers simple guidance as to how to legally employ foreign workers.  More detailed guidance is available on the Home Office website listed under external links opposite.

 

We propose a simple four step approach, indexed opposite.  This should automatically apply to all potential employees whether foreign workers or not.  The application to all employees  is necessary to avoid any accusations of discrimination.  Now move to Step 1 indexed opposite.
