DTI guidance

Notice periods should be set down in the contract.  As a matter of good practice keep them to as short as possible - time to recruit a replacement or time to restrain the individual from working for a direct competitor.

Notice periods generally tie in with redundancy payments.  Most employers set down one months notice for the first two years and increase the notice by one week per years service up to 12 weeks maximum.  For managers that increases to 12 weeks rising by one week per year to 24 weeks.  For directors the notice period would normally be one year.  A number of studies have criticised Directors' notice periods beyond one year.

Example Clauses

You will be entitled to twelve weeks notice of termination of your employment by the Company.

Should you wish to terminate your contract you are required to provide twelve weeks notice of termination of your employment to the Company.
